RECI'fAI.5 A. The City is the fee owner of thaY oermin real property located in the City of Redwood City, Califomia, which is described more specifically on E�ibit A to tlris Agreement (the "Property'�. B. The City and BIAC are parties to a sep�tate lease agrcemeat (the I "L.ease Pursuant to which BIAC lease &om the City certain property commonly lmown as �.450 Maple Street, Redwood City, Califmnis, which BIAC uses in the operation of an aquatic center (the °Aqurtic Center"). . C. BIAC desires w use a poction of the Property to store �ailers and certain other equipment used in connecdon with the Aquatic Center. NOW, THEREFORE, the parties agee as follows: i AGREEMENT 1. C'nant of License• License Area For good and valuable consideiation, receipt of which is hereby acknowledged, statting on Jtily I, 2009 (the "Commencement I DAte'�, the City grants to BIAC a non-exclusive, personal and revocable license to enter the Licease Area (defined below) for the express and limited purpose of conduc6ng the Activities as defiaed below in Section 4(the "Licenae'�. The License Area is desciibed on Ea6ibit B attached to this Ageement 2. License Fee. As consideiation for the graitt of the License, BIAC shall pay the City a licen.9e fee in the amount of �750.00 per mornh (the "License Fee'�. Each monthiy installment of the License Fee shall be payable in advance, on or before the first day of each month during the term of the License. License Fees for any period during the term hereof wluch is for less than one month sLall be a pro rata portion of the monthly installment License fees shall be payable to the City at the addnss set forth in Section 19 below or ai such other address as the City may from time to time designate in writing. 3. Acknowledements bv BIAC. BIAC aclmowledges that BIAC has no right, title, or interest in or to any portion of the Property, including, without limitation, the License Area, other than the License specificelly granted by the terms of this Agreement The Liccnse is personal to BIAC and cannot be assigued, traosferred, or othenvise conveyed by BIAC or by operation of law.
