AGREEMENTS <br /> <br /> 1. Section 10.5 is added to the Agreement to read as follows: <br /> <br /> "10.5 Reimbursement to Agency. Agency shall advance to Developer the sum <br />of fifty thousand dollars ($50,000) (the "Funds") for the clearance of any asbestos <br />contained in, and the demolition of, those structures located on the Project Site and <br />further described in the attached Exhibit "D" and for the clearance of any asbestos <br />contained in the structure located on the Project Site and further described in the attached <br />Exhibit "E" (collectively the "Structures"). Developer shall have the Structures cleared of <br />asbestos and/or demolished in a timely manner. Further, Developer shall reimburse the <br />Agency for the Funds not later than the close of the escrow described in Article 4 of the <br />DDA. The funds will be in addition to any other funds owed by Developer to the Agency <br />and/or City as part of the Agreement, DDA or other agreements." <br /> <br /> 2. All other provisions of the Agreement, as may have been amended from <br />time to time, shall remain in full force and effect. <br /> <br /> 3.
