Professional Liability $1 million per claim and <br /> aggregate <br /> <br /> Prior to performing any work on the Project Site, Developer shall furnish City <br />and Agency with certificates and copies of information or declaration pages of the <br />insurance required hereunder and, with respect to evidence of commercial general liability <br />and automobile liability insurance coverage, original endorsements: <br /> <br /> a. Naming City and Agency, their officials, officers, employees and <br />agents as additional insureds by endorsement with respect to performance of this <br />Agreement. The coverage shall contain no special limitations on the scope of its <br />protection afforded to the above-listed additional insureds. <br /> <br /> b. Providing that such coverage shall be primary with respect to any <br />insurance or self-insurance programs covering City, the Agency, and their officials, <br />officers, employees and agents. <br /> <br /> c Providing that such insurance shall apply separately to each insured <br />against whom claim is made or suit is brought, except with respect to the limits of the <br />insurer's liability (cross liabiltiy endorsement). <br /> <br /> d. With respect to professional liability insurance, Developer shall <br />require the engineer and its subconsultants who are performing design or engineering <br />services in connection with the Work to maintain Professional Liability Insurance which <br />shall provide coverage for claims arising out of professional services caused by errors, <br />omissions, or negligent acts of any of the foregoing in connection with the carrying out <br />of their responsibilities for the Work. The Professional Liability Insurance shall have <br />limits of not less than $1 million to cover each insured, with such limits applying <br />separately to each insured. Developer shall require the engineer and its subconsultants <br />to furnish an endorsement or endorsements extending the reporting period for claims <br />arising from the Work two (2) years from the date the City accepts the Work. <br /> <br /> e. Other insurance requirements. <br /> <br /> i. The certificates of insurance and endorsements to be <br />furnished hereunder shall provide that such insurance shall not be canceled, allowed to <br />expire or be materially reduced in coverage except on thirty (30) days prior written notice <br />to City and Agency. <br /> <br /> ii. Developer shall replace or require the replacement of <br />certificates, policies and endorsements for any insurance required herein expiring prior to <br />completion and acceptance of the Work. <br /> <br /> iii.
