B. - Page 45 <br />DECLARATION OF COVENANTS AND RESTRICTIONS FOR <br />THE 333 MAIN STREET CONDOMINIUMS <br />THIS DECLARATION, made on the date hereinafter set forth, by 333 MAIN STREET RWC, <br />LLC, a Delaware limited liability company, hereinafter referred to as "Declarant," is made with <br />reference to the following facts: <br />A. Location of Property. Declarant is the Owner of certain real property (the <br />"Property ") located in the City of Redwood City ( "City "), County of San Mateo ( "County "), State of <br />California, more particularly described as "Tract No. 333 Main Street for Condominium <br />Purposes" on that certain Map filed for record in the Office of the Recorder of San Mateo County, <br />California, on , 201_, in Book of Maps, page(s) <br />B. intention. Declarant intends to improve said real property by constructing one <br />hundred thirty -two (132) Condominiums. Declarant intends to create a "condominium project," as <br />defined in Section 1351(f) of the California Civil Code, to subdivide the properties as authorized by <br />Section 66427 of the California Government Code into "condominiums" as defined in Section 783 of <br />the California Civil Code and to impose mutually beneficial restrictions under a general plan of <br />improvement for the benefit of all the Condominiums created pursuantto the Davis - Stirling Common <br />Interest Development Act. <br />C. Owner's Interest. The development shall be referred to as the "Project" as defined <br />in Section 1.48. The Owner of a Condominium will receive a separate interest in an individual Unit <br />and an undivided 11132 interest in common in the Common Area. Each Condominium shall have <br />appurtenant to it a membership in the 333 Main Street Homeowners Association, a nonprofit mutual <br />benefit corporation, which shall manage and operate the Common Area. <br />D. General Plan of Improvement. Declarant intends bythis documentto impose upon <br />the Project mutually beneficial restrictions under a general plan of improvement for the benefit of all <br />of the Condominiums and the Owners thereof. <br />NOW, THEREFORE, Declarant hereby declares that the Project shall be held, conveyed, <br />mortgaged, encumbered, leased, rented, used, occupied, sold, and improved, subject to the <br />following declarations, limitations, covenants, conditions, restrictions and easements, all of which <br />are imposed as equitable servitudes pursuant to a general plan for the development of the Project <br />for the purpose of enhancing and protecting the value and attractiveness of the Project, and every <br />part of it, in accordance with the plan for the improvements of the Project and its division into <br />Condominiums.
