6. 1. B. - Page 71 <br />(3) Fees. Whether the monthly fee charged to the Association by the <br />Service Provider for the provision of the Telecommunications Services to all of the Condominiums <br />represents a discount from the comparable retail fees charged by the Service Provider in the <br />general geographic area in which the Project is located, and, if so, the amount of such discount. <br />(4) Installation of Telecommunications Facilities. Whetherthe Service <br />Provider is solely responsible for the installation, and the cost thereof, of all of the <br />Telecommunications Facilities necessary to provide Telecommunications Services to each <br />Condominium. <br />(5) Removal of Telecommunications Facilities. Whether the Service <br />Provider has the right to remove the Telecommunications Facilities upon expiration or termination of <br />the Telecommunications Contract. <br />M. Delegation: The Board, and the officers of the Association shall have the <br />power to delegate their authority and powers to committees, officers or employees of the <br />Association, or to a manager employed by the Association, provided that the Board shall not <br />delegate its responsibility: <br />(1) to make expenditures for capital additions or improvements chargeable <br />against the Reserve Funds; <br />(2) to conduct hearings concerning compliance by an Owner or Occupant <br />with the Governing Documents; <br />(3) to make a decision to levy monetary fines, levy Reimbursement <br />Charges, temporarily suspend an Owner's rights as a Member of the Association or otherwise <br />impose discipline; <br />(4) to make a decision to levy Regular Assessments or Special <br />Assessments; or <br />(5) to make a decision to bring suit, record a claim of lien or institute <br />Foreclosure proceedings for default in payment of Assessments. <br />N. Security: The Board shall have the power, but not the obligation, to contract <br />for security service for the Common Area. Notwithstanding the foregoing, if the Association elects to <br />provide any security services or systems, neither the Association nor the Board shall be deemed to <br />have made any representation orwarranty to any Owneror Occupant, norto any other Person using <br />the facilities or Improvements within the Project regarding security or safety. Each Owner shall be <br />responsible for the security and safety of Persons who occupy or use the Condominium owned by <br />the respective Owner. The Association shall not be subject to any claims or liability in connection <br />with the provision of any security service or security system, or the failure to provide any security <br />service or security system, within any portion of the Project. <br />O.
