6.1. B. - Page 106 prosecute any required legal action to obtain compliance with the provisions contained in this paragraph. The City, in enforcing the provisions contained in this paragraph, shall be entitled to all the rights and remedies of an Owner or of the Association. The City shall be entitled to all expenses of enforcement, regardless of whether legal proceedings are instituted, including the enforcement by private, legal counsel, and shall have the authority to lien the subject property (including the individual Units permitted by law) if the Association does not pay the City for all expenses of correction and enforcement. The prevailing party shall also be entitled to all costs, expenses and attorneys' fees in the event of a dispute between the City and any Unit Owner and /or the Association regarding collection of the expense of enforcement. All funds obtained by lien, other legal proceedings, or any action in furtherance of such enforcement by the City shall be utilized by the City to repay the City for the costs of correcting the breach after costs of expenses of enforcement shall first have been deducted. F. Amendments to Declaration. Notwithstanding any language to the contrary, no amendment to this Section 10.19 shall be effective without the priorwritten consent of the City as authorized by the City Manager.
