SIB I <br />November 3, 2003 <br />Subject <br />Final Acceptance - Marie La Rocca Estates Subdivision <br />Recommendation <br />Accept the improvements for the Marie La Rocca Estates Subdivision located at 1425 <br />Kentfield Avenue, and authorize the release of bonds, following the submission of a <br />Maintenance Bond in the amount of $42,500.00. <br />Background <br />On January 15, 2002, the City Council approved Marie La Rocca Estates Subdivision, <br />and the Subdivision Agreement for the improvements. The subdivider, La Rocca Turner <br />Development, LLC, a California limited liability company, has completed the <br />construction of the improvements in accordance with the Subdivision Agreement. The <br />improvements in the public right -of -way included a 12 -inch storm drain section along <br />Kentfield Avenue; including associated work (curb & gutter, sidewalk, and street light). <br />The subdivider provided a Faithful Performance Bond and a Labor & Materials Bond, <br />each in the amount of $425,000.00, which can now be released following the <br />submission of a Maintenance Bond in the amount of $42,500.00. <br />Alternative <br />Do not accept the Marie La Rocca Estates Subdivision, which would be contrary to prior <br />Council action. <br />Fiscal Impacts <br />A Maintenance Bond will be held for one year, after which maintenance will be the <br />responsibility of the City. <br />Funds are appropriated in the Public Works Services Department <br />for the maintenance of publicly owned streets, storm drainage, <br />improvements within qBruce ght -of -way and easements. <br />Phong Du iedstrand <br />Senior Civil Engineer Community Development.
