, I �_,Io <br />(a) Precluding cancellation or reduction in coverage before the expiration of <br />thirty (30) days after the Agency shall have received written notification of <br />cancellation or reduction in coverage by first class mail; <br />(b) Providing teat Permittee's insurance shall apply separatel to each <br />insured against whom claim is made or suit is brought, except with respect <br />to the limits of the insurer's liability (cross liability endorsement); <br />(c) Naming Agency and City, their boards, councils, officers, commissions, <br />employees, and agents, as additional insureds; and <br />(d) Providing that Permittee's insurance coverage shall be primary insurance <br />with respect to Agency and City, their councils, boards, officers, <br />commissions, employees, and agents, and any insurance or self - <br />insurance maintained by Agency or City, for themselves, and their boards, <br />commissions, employees, or agents shall be in excess of Permittee's <br />insurance and not contributory with it. <br />If Permittee fails to maintain any of the insurance coverage required herein, then <br />Agency will have the option to revoke this Permit, or may purchase replacement <br />insurance or pay the premiums that are due on existing policies in order that the <br />required coverage may be maintained. Permittee is responsible for any payments <br />made by Agency to obtain or maintain such insurance and Agency may collect the <br />same from Permittee or deduct the amount paid from any sums due Permittee under <br />this Permit. <br />13. Compliance with Laws. Permittee shall comply with all laws concerning <br />use and occupancy of the Property including, without limitation, the obligation at <br />Permittee's cost to maintain or restore the Property, or the equipment stored thereon, in <br />compliance with, and in conformance to, any and all laws relating to the condition, use, <br />or occupancy of the Property or the storage and use of said equipment. <br />14. Assignment and Nontransferabilitv. Permittee understands and <br />acknowledges that assignment, sublicensing or transfer of this Permit is absolutely <br />prohibited without the written consent of Agency, and any attempt to do so without <br />Agency's written consent may result in a revocation of the Permit at the will of Agency. <br />15. Non - exclusive. The permission granted by this Permit is non - exclusive in <br />nature. Agency reserves the right to enter into agreements with other parties, for use of <br />the Property. <br />16. Revocation of Permit. Permittee understands and agrees that this Permit <br />may be revoked at any time for Permittee's failure to maintain the Property as required <br />under this Permit or; for failure of Permittee to comply with any of the other terms and <br />conditions hereof, notwithstanding any investment of Permittee in improving the <br />Atty /Permits /Permit.008 5 <br />102203 <br />
