WHEREAS, Irvine is willing to provide, at Irvine's cost and expense, for <br /> <br />the construction of street improvements to the Street Parcel, subject to the terms <br /> <br />and conditions hereof; <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. Improvements. Upon City's acquisition of the property interests <br /> <br />described in, and pursuant to, paragraph 2, and upon written notice to proceed <br />given by City, Irvine shall, at Irvine's own cost and expense, construct all of the <br />improvements ("Street Improvements"), furnish all the materials, and do all the <br />work hereinafter described in accordance with, and as provided for, in the plans <br />and specifications prepared for Irvine by Wilsey Ham, Engineers, Planners, and <br />Surveyors, entitled, "Plans for Bair Island Road Reconstruction" (collectively, the <br />"Plans/Specifications"), and in accordance with City's specifications entitled, <br />"Engineering Standards-City of Redwood City" (the "Standards"), in effect as of <br />the date of final approval by City of the Plans/Specifications, which <br />Plans/Specifications and Standards are on file in the office of the City Engineer <br />and are incorporated herein by reference. The Street Improvements shall also <br />be constructed in strict compliance with the provisions of Article VII, Chapter 29 <br />of the Code of the City of Redwood City (the "Code Provisions"), also <br />incorporated herein by reference.
