All documents, plans and drawings, renderings, estimates, and other papers, or copies thereof, as finally rendered, prepared by CM/GC pursuant to the terms of this Agreement, shall, upon preparation and delivery to City, become the property of City. 14. SCHEDULE. CM/GC shall generally adhere to t~e schedule referenced in Exhibit "A"; provided, that City shall grant reasonable extensions of time for the performance of such services in accordance with the General Conditions. CM/GC acknowledges to City the importance of City's Project schedule and agrees to put forth its best professional efforts to perform its services under this Agreement and cause the services of others to be performed in a manner consistent with the schedule referenced in Exhibit "A", as amended from time to time. City understands, however, that CM/GC's performance must be governed by sound construction management practices. 15. LIQUIDATED DAMAGES. It is hereby agreed by the parties to this Agreement that in case all work called for under this Agreement is not finished or completed on or before the time set forth in this Agreement, damage will be sustained by City, and that it is and will be impracticable and extremely difficult to ascertain and determine the actual damage which the City will sustain in the event of and by reason of such delay; it is therefore agreed CM/GC will pay to City the sum calculated at the rate of One Thousand and No/100 Dollars ($1,000.00) per day as liquidated damages for each and every calendar day's unexcused delay in substantially completing the construction of the Project within the time prescribed.
