All documents, plans and drawings, <br /> <br />renderings, estimates, and other papers, or copies thereof, as <br />finally rendered, prepared by CM/GC pursuant to the terms of this <br />Agreement, shall, upon preparation and delivery to City, become <br />the property of City. <br /> <br /> 14. SCHEDULE. CM/GC shall generally adhere to t~e schedule <br />referenced in Exhibit "A"; provided, that City shall grant <br />reasonable extensions of time for the performance of such <br />services in accordance with the General Conditions. <br /> <br /> CM/GC acknowledges to City the importance of City's Project <br />schedule and agrees to put forth its best professional efforts to <br />perform its services under this Agreement and cause the services <br />of others to be performed in a manner consistent with the <br />schedule referenced in Exhibit "A", as amended from time to time. <br />City understands, however, that CM/GC's performance must be <br />governed by sound construction management practices. <br /> <br /> 15. LIQUIDATED DAMAGES. It is hereby agreed by the parties <br />to this Agreement that in case all work called for under this <br />Agreement is not finished or completed on or before the time set <br />forth in this Agreement, damage will be sustained by City, and <br />that it is and will be impracticable and extremely difficult to <br />ascertain and determine the actual damage which the City will <br />sustain in the event of and by reason of such delay; it is <br />therefore agreed CM/GC will pay to City the sum calculated at the <br />rate of One Thousand and No/100 Dollars ($1,000.00) per day as <br />liquidated damages for each and every calendar day's unexcused <br />delay in substantially completing the construction of the Project <br />within the time prescribed.
