The Agency and the District <br />,intend that this Agreement shall pertain to and control the <br />allocation and payment of Tax Increment from only the Amendment <br />Area, and that the Tax Increment from the Existing Project Area <br />shall continue to be allocated and paid to the Agency in <br />accordance with section b of the Health & Safety Code. <br />Payip nts to District The Tax Increment from the <br />Amendment Area that would otherwise be allocated and paid to the <br />District but for the provision of tax increment financing in the <br />Second Amendment, less such amount as the Agency is required to <br />deposit in the Housing Fund as described in section 5. of this <br />Agreement, shall be allocated and paid fifty percent (50%) to the <br />Agency and fifty percent to the District. <br />In consideration of the payments that the District will <br />receive under this section, the District agrees to waive, and by <br />executing this Agreement does waive any right to make the <br />
