6.5.A. - Page 2 <br /> containers ("clamshells"), but excluding disposable packaging for unprepared <br /> food. <br /> • Automatic exemptions contained in the ordinance are prepackaged foods, and <br /> polystyrene coolers and ice chests. <br /> • Other requests for exemptions may be made for undue hardship where a suitable <br /> alternative does not exist for a specific application and/or situations where no <br /> reasonably feasible alternative exists to a specific and necessary prohibited <br /> container. <br /> • The application process for seeking an exemption is through the County's <br /> Environmental Health Division and, if granted, is for the period of one year. <br /> • The County's Environmental Health Division will administer and enforce the <br /> ordinance and may issue fines for violations in an amount not to exceed $100 for <br /> a first violation, $200 for a second violation, and $500 for a third violation. After <br /> ample opportunities to comply, any fines levied would go to the County, <br /> earmarked for use to supplement outreach and education around polystyrene. <br /> • Effective date established as January 1, 2013, in order to provide 30 days for the <br /> ordinance to become effective and six months as a transition period <br /> Attachment 4 provides a synopsis of the information gathered from five other cities in <br /> San Mateo County — Burlingame, Half Moon Bay, Foster City, San Bruno, and Millbrae <br /> (the latter two implemented their own "stand alone" ordinances). In summary, the <br /> "phase-in" period between adoption of the ordinance and the start of enforcement <br /> ranged from three months to over one year. Cities implemented a variety of outreach <br /> methods, which Redwood City would also perform, such as informational meetings and <br /> presentations with businesses, personal contact, website/email outreach, and direct <br /> mail. All cities reported a fairly smooth implementation. The common advice received <br /> was to involve businesses early, partner with business groups, and maintain a positive <br /> and transparent quality of outreach. <br /> Staff recommends a six month phase-in period for Redwood City's ordinance. However, <br /> the City Council could elect to establish a different effective date. To commence the <br /> transition period, staff recommends that at the second reading the City Council adopt <br /> the attached resolution articulating Redwood City's policy goals with respect to <br /> polystyrene and establishing a voluntary compliance program for which early-adopters <br /> of the program could be recognized, as part of the transition to a mandatory program. <br /> The resolution also requires that the City itself comply with the program in ordering its <br /> own food service ware. <br /> During the transition period, the County has agreed to assist Redwood City with <br /> planning and implementing education and outreach to the approximately 550 affected <br /> businesses identified in Redwood City, to include: <br /> • contacting and working with the Chamber of Commerce and the Downtown <br /> Business Group for dissemination of information <br /> • providing standardized bilingual outreach materials <br /> • funding the printing and postage costs for one direct mailing <br /> • staffing of City business community informational workshops <br />
