D. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> April 9, 2012 <br /> SUBJECT <br /> Amendment Number 2 to Professional Services Agreement with Jones & Stokes Inc., a <br /> subsidiary of ICF International (ICF), for additional environmental services for the 640 <br /> Veterans Boulevard project <br /> RECOMMENDATION <br /> Approve, by motion, Amendment Number 2 of the Professional Services Agreement <br /> with ICF for additional environmental work for the 640 Veterans Boulevard project <br /> (Attachment 1). <br /> BACKGROUND <br /> The original contract with ICF, dated June 7, 2011, involved the preparation of an Initial <br /> Study/Mitigated Negative Declaration (IS/MND) for the 264-unit residential project at <br /> 640 Veterans Boulevard. The original contract including sub-consultant work was in the <br /> amount of $59,846. <br /> ANALYSIS <br /> During the environmental review process, the law firm of Adams Broadwell Joseph & <br /> Cardozo (ABJC) submitted comments questioning the adequacy of the draft IS/MND. <br /> ABJC also filed a public records request during that period. On January 23, 2012, the <br /> City Council approved Professional Services Amendment Number 1 with ICF to cover <br /> the consultant's cost of processing the above-referenced comments. The amendment <br /> added $12,964 for a total agreement of $72,810. <br /> On January 31, 2012, the Planning Commission adopted the IS/MND and approved the <br /> Planned Development permit for the project. On February 7, 2012, ABJC appealed the <br /> decisions of the Planning Commission. Work was begun by City staff and ICF on the <br /> preparation of the response to the appeal. During this period, meetings and other <br /> coordination were required between ICF and project sub-consultants and City to <br /> respond to the appeal and coordinate the public hearing. On February 22, 2012, ABJC <br /> withdrew their appeal; however, the consultants had already worked two weeks <br /> preparing for the appeal. <br /> The cost of the additional two weeks of preparation is $1,316. If approved by the City <br /> Council, the additional work will constitute contract Amendment Number 2, bringing the <br /> total cost of services with ICF to $74,126. The Project developer has sufficient funds <br /> deposited with the City to cover the additional costs. <br />
