oaiosno�z <br /> ATTACHMENT <br /> AMENDMENT NUMBER 1 <br /> AGREEMENT FOR MAINTENANCE OF STATE HIGHWAYS <br /> IN THE CITY OF REDWOOD CITY <br /> This Amendment No. 1 to AGREEMENT FOR MAINTENANCE OF STATE <br /> HIGHWAYS IN THE CITY OF REDWOOD CITY ("AGREEMENT") is made and entered into <br /> by and between the State of California, acting by and through the Department of Transportation, <br /> hereinafter referred to as "STATE", and the City of Redwood City, hereinafter referred to as <br /> "CITY", and collectively referred to as "PARTIES" is hereby entered into on , 2012. <br /> RECITALS: <br /> l. PARTIES executed AGREEMENT on July I, 2001, as provided for in section 130 ofthe <br /> Streets and Highways Code. <br /> 2. Pursuant to the terms and conditions of said AGREEMENT, CITY agreed to perform <br /> such maintenance work specifically delegated to it on the identified State highway routes <br /> or portions thereof, as described in Exhibit A of AGREEMENT, or as said Exhibit may <br /> be subsequently modified with the consent of the parties hereto acting by or through their <br /> authorized representatives. <br /> 3. Said Exhibit A describes the CITY's maintenance responsibilities for landscaping and <br /> street sweeping along State Route ("SR") 84 from west City limits a[ Alameda de la <br /> Pulgas to Cypress Street, a length of 1.70 miles and designated in said Exhibit A as "SR <br /> 84(a) <br /> 4. CITY now desires to assume certain maintenance responsibilities along SR 84 from <br /> Cypress Street to the west side of Broadway Street, including the interchanges at SR 82 & SR <br /> ' 84, a length of 1.2 miles and designated in the new Exhibit A as "SR 84(b)." <br /> 5. A Freeway Maintenance Agreement ("FMA") was executed between PARTIES on <br /> February 15, 1965, that delineated certain maintenance responsibilities for SR 84 (b). <br /> This Amendment is not intended to amend, replace, or supersede said 1965 FMA. <br /> IT IS NOW THEREFORE MUTUALLY AGREED: <br /> The attached EXHIBIT "A", noted as Amendment No. 1, dated , and <br /> numbered Page 6 of 7 and Page 7 of 7, shall cancel and supersede such like numbered pages in <br /> AGREEMENT and become a part of AGREEMENT for all purposes. Except as expressly <br /> amended hereby, AGREEMENT shall remain in full effect as originally executed on July I, <br /> 2001. All rights and obligations of PARTIES under AGREEMENT that are not expressly <br /> amended by this Amendment shall remain unchanged and in effect as originally executed. <br /> RESO. # 15180 <br /> MUFF # 304 <br />
