o�tc��. <br /> REVOCABLE LICENSE AGREEMENT <br /> BETWEEN THE CITY OF REDWOOD CITY <br /> AND <br /> REDWOOD CITY ROTARY CHARITABLE FOUNDATION <br /> FOR <br /> A CERTIFIED FARMERS MARKET ON BROADWAY/HAMILTON STREET <br /> IN REDWOOD CITY <br /> THIS REVOCABLE LICENSE AGREEMENT ("AgreemenY') is made and <br /> entered into as of March 19, 2012 (Effective Date), by and between the CITY OF <br /> REDWOOD CITY (hereinafter City), a California Charter City and municipal corporation, <br /> and REDWOOD CITY ROTARY CHARITABLE FOUNDATION (hereinafter "Licensee"), <br /> a non-profit organization. <br /> RECITALS <br /> A. Licensee exists for the purpose of developing, organizing, operating and <br /> managing "Certified Farmers' Markets" (as such term is defined in Section 27512 of the <br /> California Health and Safety Code and Article 6.5, Title 3 of the California Administrative <br /> Code). <br /> B. Licensee desires to organize, operate, maintain and manage a Certified <br /> Farmers' Market in City on property owned and maintained by City for the benefit of and <br /> use by members of the general public. <br /> C. City desires to allow such use by Licensee, provided that the public health° <br /> safety and welfare are not thereby impinged, diminished or adversely affected. <br /> NOW, THEREFORE, in consideration of the recitals and mutual obligations <br /> contained herein, City and Licensee agree as follows: <br /> 1. Nature of Aqreement. The nature of the right granted by City to Licensee is <br /> that of a revocable license and not a permit nor a lease. No property right is granted <br /> hereby; notwithstanding the foregoing, Licensee hereby knowingly waives and relin- <br /> quishes any rights it may have or claim to have pursuant to California Government <br /> Code Sections 7260 through 7277. <br /> 2. License Area. The real property permitted to be used under this Agreement <br /> is that certain property located on Broadway from Winslow Street to Theatre Way, and <br /> on Hamilton Street from Marshall Street to Winslow Street, Redwood City, California <br /> ("Farmers' Market Area"). The Farmers' Market Area is more particularly described in <br /> Exhibit "A-1", attached hereto and incorporated herein by reference. Licensee's use of <br /> the Farmers' Market Areas shall be in accordance with the Site Plan, attached hereto as <br /> Exhibit "A-2° and incorporated herein by reference.
