DES:dft /21/95 (046/38) <br /> <br /> WHEREAS, the aforementioned EIR, together with the two <br />supplemental reports and an additional traffic study prepared by <br />Barton-Aschman Associates, dated March 13, 1985, were likewise <br />prepared in connection with the prior proposed development; and <br /> <br /> WHEREAS, in accordance with the provisions of California <br />Government Code Section 65864, et seq. and pursuant to Ordinance <br />No. 1917 entitled, "Ordinance Approving and Authorizing Execution <br />of Development Agreement With Westport Investments (GID 1-64); <br />and Making Certain Findings With Respect Thereto", adopted August <br />26, 1985, the City of Redwood City and GID 1-64 entered into that <br />certain development agreement with Westport dated September 11, <br />1985 (the "1985 Development Agreement"); and <br /> <br /> WHEREAS, pursuant to the 1985 Development Agreement <br />Westport paid to the City a facilities fee for certain off-site <br />public improvements constructed, or to be constructed, by GID <br />1-64; and <br /> <br /> WHEREAS, additional traffic studies were conducted regarding <br />the then proposed development entitled, "Transportation Planning <br />Study for the Redwood Shores/101 Corridor", by Crain & <br />Associates, dated November 1987 (the "Crain Study"); and <br /> <br /> WHEREAS, in 1988 a revised development proposal was <br />submitted for the Property and in connection therewith an EIR <br />entitled, "Final Environmental Impact Report, Westport <br />Development, Redwood City, California", dated November, 1988 (the <br />"1998 FEIR"), was certified by the Planning Commission as having <br />been completed in compliance with CEQA; and <br /> <br /> WHEREAS, in 1989 a draft supplemental environmental impact <br /> <br /> report (the "SEIR"), in the form of a health risk assessment, was <br /> 2 <br /> <br /> <br />
