6.3.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> May 7, 2012 <br /> SUBJECT <br /> Agreement for Professional Services between City as Successor Agency and Best, Best <br /> & Krieger <br /> RECOMMENDATION <br /> By Motion Authorize City Attorney to Execute Agreement To Provide Professional <br /> Services of Best, Best & Krieger to City acting as Successor Agency Effective February <br /> 1, 2012. <br /> BACKGROUND <br /> AB x1 26, the Dissolution Act, dissolved the Redwood City Redevelopment Agency <br /> (RDA) effective February 1, 2012. The Dissolution Act mandated that the City acting as <br /> the Successor Agency (unless it turned this obligation over to another agency) wind <br /> down the affairs of the RDA. The City elected to become the Successor Agency and is <br /> taking the requisite actions under the law to effectuate the RDA's dissolution under the <br /> guidance of the newly instituted Redwood City Oversight Board. <br /> ANALYSIS <br /> The City Attorney's Department provides legal representation to the Successor Agency. <br /> In addition, the services of special counsel are recommended in order to assist in <br /> interpreting the Dissolution Act and to assist the City Attorney's Department with filing <br /> any legal actions that may be necessary relating to redevelopment's dissolution. <br /> Currently, the City has an agreement with Best, Best & Krieger ("BBK") that covers both <br /> BBK's City related work and RDA related work, but the reviewing agencies have <br /> declined to recognize this financial obligation unless memorialized by an agreement <br /> between BBK and the City acting as Successor Agency. The agreement's effective <br /> date is February 1, 2012, to be concurrent with the dissolution of the RDA. <br /> FISCAL IMPACT <br /> The BB&K attorney designated to provide services is Iris Yang whose hourly billing rate <br /> is $295. The Successor Agency budgeted $20,000 for the period February through June <br /> 2012. As the City Attorney's Department provides primary redevelopment legal <br /> services, BBK's billing for the initial ROPS period is likely to be substantially less than <br /> the budgeted amount. The Successor Agency has also budgeted $24,000 for the fiscal <br /> year 2012-2013, but the expenses are difficult to forecast because the Dissolution Act is <br />
