FXS:dft 9'~9/94 (017/38) <br /> <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br />AS FOLLOWS: <br /> <br /> 1. This Council hereby finds that that certain sewer and <br />public utility easement described on page I of Exhibit "A" and <br />depicted on page 2 hereof with the designation "Plat of Easement <br />to be Vacated (which Exhibit is hereby incorporated herein by <br />reference) has been superseded by relocation, there are no other <br />public facilities located within said easement, and said easement <br />is no longer required for public purposes and, therefore, said <br />easement shall be, and is hereby ordered, vacated. <br /> <br /> 2. The City Clerk is hereby authorized and directed to <br />accept, on behalf of the City, a deed of easement (in form <br />approved by the City Attorney) conveying to the City equivalent <br />easement rights to that easement ordered vacated pursuant to <br />paragraph 1 hereof, in and to all that certain real property <br />described on page I of Exhibit "B" and depicted on page 2 hereof <br />with the designation "Plat of Public Service Easement" (which <br />Exhibit is hereby incorporated herein by reference). <br /> <br /> 3. Upon acceptance of the deed described in paragraph 2 <br />hereof, the City Clerk is hereby authorized and directed to <br />record, or cause to be recorded, a certified copy of this <br />resolution together with the aforesaid deed and a resolution of <br />acceptance pertaining thereto in the office of the County <br />Recorder of the County San Mateo. <br /> <br /> <br />
