6.1. B. - Page 3 <br /> AMENDMENT NO. 3 <br /> TO EXTEND AGREEMENT <br /> FOR <br /> 2009-2010 Cost Shared Sidewalk Repair Project <br /> SpenCon Construction, Inc. <br /> This Amendment No. 3 is entered into and effective as of the day of <br /> , 2012, extending the agreement dated August 1, 2009 (the <br /> "Agreement") by and between the City of Redwood City, a charter city and municipal <br /> corporation of the State of California ("City"), and SpenCon Construction, inc., <br /> ("Contractor") (collectively, the "Parties") for performing sidewalk repair services. <br /> RECITALS <br /> A. On August 1, 2009, the Parties executed an Agreement for Cost Shared <br /> Sidewalk Repair Project; and <br /> B. On November 8, 2010 the Parties executed Amendment Number 1 to the <br /> Agreement for Cost Shared Sidewalk Repair Project; and <br /> C. On September 14, 2011, the Parties executed Amendment Number 2 to <br /> the Agreement for Cost Shared Sidewalk Repair Project; and <br /> D. The Parties desire to extend the Agreement for a period of one year <br /> through June 11, 2013. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. Contractor will provide those services described in the Agreement. With <br /> this Amendment, the total aggregate Agreement amount shall not exceed Seven <br /> Hundred Seventy Five Thousand Two Hundred Fifty Five and 00/100 dollars <br /> ($775,255.00). <br /> 2. City will pay Contractor for all work associated with those services <br /> described in the Agreement on a unit bid price basis not-to-exceed One Hundred Fifty <br /> Thousand dollars ($150,000.00). Contractor will provide City, on a monthly basis, copies <br /> of invoices sufficiently detailed to include work performed, unit bid rates, and related <br /> activities and costs for approval by City. <br /> 3. Contractor will perform tasks described in the Agreement through June 6, <br /> 2013. <br /> 4. All other provisions of the Agreement, as may have been amended from <br /> time to time, will remain in full force and effect. <br /> 5.
