1a��:�� . and WHEREAS,the City's areas to be cape sealed in accordance with this Agreement are shown on "Exhibit A", attached hereto and incorporated by this reference; and WHEREAS, the proposed cape sealing work of portions of Wilmington V�%ay, California Way, and Hamilton Way shall include, but not be limited to: mobilization, maintaining traffic, application of cape seal, and other items of work associated with the road cape sealing work ("the project"). NOW, THEREFORE,IT IS AGREED AS FOLLOWS: 1. County will include in its contract, for the above-described project, contract items for the cape sealing of portions of Wilmington Way, California Way and Hamilton Way within the corporate limits of the City. The work shall be completed by the County's Contractor. 2. County will award the contract to the lowest responsible bidder for tlie completion of this project. 3. County agrees to notify the City of the successful bidder to whom the construction contract is to be awarded. 4. City agrees to reimburse County, on demand, for(a)the actual construction contract costs (including contract Change Order costs) incurred by County for work on the cape sealing of City facilities on portions of Wilmington Way, California Way and Hamilton Way and (b)ten percent(10%) of the actual construction contract costs (including Change Order costs) for overhead expenses incurred by County for work on said City's facilities. 5. The estimated maximum fiscal obligation for work on said City's facilities is $12,138, unless authorized by City in writing. Any Contract Change Orders on the City's portion of the construction work will be subject to the written approval by the City.
