DES:d~t 4/01/93 (015/10) <br /> 1/17/94R <br /> <br /> "Section 14.95. Abandoned Carts. Any Cart not <br /> <br />identified in accordance with Section 14.94 and not in the <br />immediate possession or control of a person or persons <br />lawfully entitled thereto, which has been deposited on <br />Public Property shall be deemed abandoned. The Director may <br />remove such Cart or part thereof from said Public Property <br />and may abate the nuisance created thereby by disposing of <br />the Cart, or portion thereof, by sale at public auction, <br />retaining the Cart or part thereof for any City purpose, or <br />directing that the Cart or part thereof shall be demolished <br />and destroyed. <br /> <br /> "Section 14.96. Penalty. Any Owner of a Cart who <br />maintains or permits the maintenance of any Cart in <br />violation of the provisions of Section 14.94, shall be <br />guilty of an infraction, and upon the conviction thereof, <br />shall be punishable as set forth in Section 1.7(b) of this <br />Code. <br /> <br /> "Section 14.97. Cumulative Effect. The provisions of <br />this Article are cumulative in addition to any and all other <br />procedures or remedies provided in ordinances of this City <br />or by State law for the abatement of nuisances, and <br />proceedings for abatement pursuant to this Article shall not <br />prejudice nor affect any other action, whether civil, <br />criminal or equitable, for the abatement or other remedy of <br />such conditions. Nothing contained herein shall be deemed <br />to invalidate, supercede, or render ineffective any other <br />provision of this Code or any ordinance of the City. <br /> <br /> 4 2075 <br /> <br /> <br />
