8.A. - Page 68 <br /> ATTACHMENT2 <br /> Public Works shall recommend formal acceptance of the improvements by <br /> the Council when he is fully satisfied that they have been installed in complete <br /> conformance with the provisions of this Chapter and with the "as built" plans. <br /> 56. If the applicant does not choose to construct all required improvements prior to <br /> recordation of the Final Map, then the applicant shall enter into a Subdivision <br /> Improvement Agreement with the City and provide a financial guarantee in the <br /> amount and in the form acceptable to the City, prior to recording the Final Map. <br /> Completion of the subdivision improvements and submittal and acceptance of <br /> the Completion Plans is required prior to the release of the subdivision financial <br /> guarantees. <br /> 57.The Final Map prepared and submitted for City review and approval shall be <br /> consistent with and fulfill the conditions of approval herein and shall comply <br /> with the requirements of RCMC Chapter 30 and the Subdivision Map Act. The <br /> Final Map shall not be recorded until all the subdivision improvements are <br /> constructed, or the applicant has entered into a Subdivision Improvement <br /> Agreement and provided financial guarantees acceptable to the City to ensure <br /> the construction of the subdivision improvements. <br /> 58.The individual lots may not be sold or conveyed until the Final Map has been <br /> recorded. <br /> 59.Applicant shall indemnify, defend, and hold harmless the City, its officers, <br /> employees and agents, including but not limited to the Planning Commission <br /> and the City Council and the Planning Commission's and City Council's <br /> officers, employees and agents, from any and all claims, lawsuits, actions, or <br /> proceedings from third party(ies) involving or related to the City's <br /> consideration and/or approval of Finger Avenue Planned Development Permit <br /> Application No. PD2008-06. The City shall promptly notify Applicant of any <br /> such claim, action or proceeding and shall cooperate fully in the defense. <br /> Section 6.
