(_�, I <br />REPORT <br />Tt th e : .446h6rabie: UlaYor and City Council <br />: <br />s <br />Froth the Ci AAanager <br />December 1, 2003 <br />Subject <br />Amendment No. 2 to Consultant Agreement with Harris & Associates relating to the <br />Ralston Avenue /Marine Parkway Interchange Improvement Project. <br />Recommendation <br />Approve Amendment No. 2 to the agreement with Harris & Associates for providing <br />professional construction management services for the Ralston Avenue /Marine <br />Parkway Interchange Improvement Project, in an amount not to exceed $1,378,791. <br />Background <br />In February 2003, the City Council approved and authorized the execution of an <br />agreement with Harris and Associates for providing professional construction <br />management services for the Ralston Avenue /Marine Parkway Interchange <br />Improvement Project in the total amount of $1.5 million, which is the total effort that <br />Harris and Associates is anticipated to put forth in the management of the entire <br />construction period (approximately two (2) years). <br />Because of the uncertainties of the scope of work, and the requirement that Harris & <br />Associates "get on board" to assist staff with value engineering and pre- construction <br />review, agreements were executed for Phase 1 (pre -bid and value engineering), and <br />Phase 2 (pre- construction services). Phase 1, was authorized and capped at $57,775; <br />Phase 2 was for an additional $63,434 for a total of $121,209. <br />This authorization of Amendment 2 will be called Phase 3, and will cover the actual <br />construction management and administration. This Amendment will allow Harris & <br />Associates to proceed with the remaining authorization of the $1,378,791, in <br />accordance with the original contract. This is a "Not to Exceed" contract, and Harris is <br />only allowed to charge their fees based on the efforts and time they put into the <br />contract. The scope of work for this contract depends largely on the project duration, <br />and the project duration depends on how efficient the Contractor is in the construction <br />methodologies and what unforeseen conditions are encountered. Therefore, it is <br />difficult to be exacting as to how much time will be put into the project. To combat this <br />situation, staff will conduct a close review of the expenditure pattern and compare it with <br />the progress of the project. Half way into the construction of this project, the variables <br />would be much easier to predict, and staff will re- evaluate the scope with the <br />Consultant. At that time adjustment to this contract may be necessary. <br />As of the writing of this report, the project construction has been awarded to O.C. Jones <br />of Berkeley, California, for their low bid of $12,426,983. The construction of the project <br />
