I
REPORT
To the Honorable Mayor and City Council
From the City Manager
EXECUTIVE SUMMARY
December 8, 2003
Subject
Appeal of the decision by the Zoning Administrator to deny an Architectural Permit for the
construction of a new single family house at 3738 Laurel Way.
Recommendation
Uphold the Zoning Administrator's decision to deny the project which enforces existing
Council policy pertaining to future development on the west end of Laurel Way.
Issues
Existing City Council Policy regarding development on the west end of Laurel Way requires
that an Environmental Impact Report (EIR) be prepared to assess the potential
environmental impacts related to further development on this substandard street. An EIR
would comprehensively address the issues in relationship to the entire street, as well as to
individual parcels. Primary issues include health /safety, access, infrastructure (utilities and
street), slope stability, native habitat, and aesthetics.
The appellant is requesting that the City Council amend their existing policy so that vacant
parcels on Laurel Way could be developed without the preparation of an EIR.
