I <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />EXECUTIVE SUMMARY <br />December 8, 2003 <br />Subject <br />Appeal of the decision by the Zoning Administrator to deny an Architectural Permit for the <br />construction of a new single family house at 3738 Laurel Way. <br />Recommendation <br />Uphold the Zoning Administrator's decision to deny the project which enforces existing <br />Council policy pertaining to future development on the west end of Laurel Way. <br />Issues <br />Existing City Council Policy regarding development on the west end of Laurel Way requires <br />that an Environmental Impact Report (EIR) be prepared to assess the potential <br />environmental impacts related to further development on this substandard street. An EIR <br />would comprehensively address the issues in relationship to the entire street, as well as to <br />individual parcels. Primary issues include health /safety, access, infrastructure (utilities and <br />street), slope stability, native habitat, and aesthetics. <br />The appellant is requesting that the City Council amend their existing policy so that vacant <br />parcels on Laurel Way could be developed without the preparation of an EIR. <br />
