u <br />S IC <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />December 15, 2003 <br />Subject <br />Final Acceptance - Roosevelt Avenue Reconstruction Project Phase II <br />Recommendation <br />Accept the improvements for the Roosevelt Avenue Reconstruction Project Phase II, <br />authorize the release of bonds and retention, and retain $10,000 to insure the last bit of <br />work is completed. The City reserves all rights regarding the pending claim, and this <br />acceptance is made without prejudice to the City's rejection of the claim or any portion <br />thereof. <br />Background <br />On January 28, 2002, the City Council awarded the Roosevelt Avenue Reconstruction <br />Project Phase II, to Interstate Grading and Paving Inc, of South San Francisco, <br />California for their bid of $3,358,373.50. <br />This project converted the overhead utilities to underground; replaced existing water, <br />sewer, and storm drain systems; reconstructed new curb, gutters, sidewalk, and <br />roadway, and installed a new street light system. <br />The contract work with Interstate Grading and Paving, inc. was completed in <br />accordance with the contract documents, except a small portion of asphalt and <br />concrete patch work left uncompleted, because of existing utility poles. These poles <br />need to be removed by SBC Pacific Bell after all overhead utilities are converted to <br />underground. SBC could not complete the removal of these existing poles, because of <br />emergency work due to the southern California fire. The minor asphalt and concrete <br />patch work will be completed soon after SBC completes the removal of the wooden <br />poles. <br />The total cost of the project is $3,516,294.21. Twelve (12) change orders were issued <br />at a total cost of $157,920.71, which represents 4.7% of the initial Bid Price. In <br />addition, there is a pending claim from Interstate Grading and Paving for a total cost of <br />approximately $250,000 concerning off - hauling of existing roadbed to a class III landfill. <br />Thus far, with the information at hand, the attorneys handling the case for City can find <br />no validity to this claim. <br />Also, In June 2003, as part of the agreement with the contractor to complete the <br />roadway work, the City Council approved the reduction of the retention to 5% from the <br />usual 10 %. <br />Page 1 of 2 <br />
