<br /> KNOW ALL MEN BY THESE PRESENTS: that, WHEREAS, the City of Redwood City("City"),
<br /> San Mateo Caunty, S#ate of Cali#ornia, has issued a Construction Permit to
<br /> RAINTREE 201 MARSHALL LLC , hereinafter designated as the �
<br /> "Principal", for constructing the following project: 201 Marshall Street
<br /> , and
<br /> WHEREAS, said Principal is required under the terms of the pennit to furnish a band for the
<br /> faithful pe�formance of said Permit;
<br /> NOW, TH�REFORE, we, the Principal, and Platte River Insurance Company , as
<br /> surety, are held and firrnly bound unto City, San Mateo Caunty, Cafifomia, in the penal sum of
<br /> Three Hundred Sixty Six Thousand, Six Hundred Fifty and 00/100 Dollais ($ 366,650.00 ),
<br /> lawful money of the United States, being one hundred percent{100%)of the Permit amount, for
<br /> the payment of which sum well and truly to be rnade, we bind ourselves, our heirs, executors,
<br /> administrators and successors,jointly and severally,firmly by these presents.
<br /> THE CONDI71dN �f THIS OBLIGATION !S SUCH, fhat if the above bounden Principal, his or
<br /> its heirs, executors, administrators, successors or assigns, shall in all fhings stand to and abide
<br /> by, and welf and truly keep and faithfully perform the covenants, conditians, and agreements in
<br /> the said Permit and any atterations made as therein provided, on his or their part,to be kept and
<br /> perfom�►ed at the time and in the manner therein specified, and in all respects according to their
<br /> true intent and meaning, and shall indemnify and save hacmless City, its Council,
<br /> Commissioners, boards, committees, officers, emptoyees and agents, as therein stipuEated,
<br /> then this obtigation shall be null and void; othenn►ise it shall be and remain in full force and
<br /> virtue.
<br /> And the said Surefy, for value received, hereby stipulates and agrees to waive the provisions of
<br /> California Civii Code Section 2819 regarding consent to change, extensivn of tirne, aiteration,or
<br /> addition to the terms of the Permit or to the work to be pertormed thereunder or the
<br /> Specifications accampanying the same shafl in any wise affect its obiigations on this bond; and
<br /> it does hereby waive notice of any such change, extension of time, alteration or addition to the
<br /> terms of the Permit, or to the work,or to the Specifications.
<br /> In the event City, ar its successors ar assigns, sha11 be the prevailing party in an action broughf
<br /> upon this bond,then, in addition#o the penal sum hereinabove specified,we agree to pay to the
<br /> said City, or its successors or assigns, a reasonable sum on account o#attomey's fees in such
<br /> acFion,which sum shall be fixed by the court.
