Project traffic signals and Intelligent Transportation System (ITS) equipment during Major Traffic Incidents. C. CITY shall have the rights to view full system CCTV camera images, during both Daily Operations and during Major Traffic Incidents. During Daily Operations both CITY and Caltrans may control PTZ(s)with priority given to the owning jurisdiction. D. CITY shall have access to view full system vehicle detection data, during both Daily Operations and during Major Traffic Incidents. Control of the vehicle detection system shall remain with Caltrans. A framework to establish priority, rules, and defaults may be developed as City deems necessary in a separate agreement between City and Caltrans. E. CITY, in its sole and absolute discretion, may opt to negotiate with Caltrans for any shared control of the directional signs during Daily Operations. F. CITY shall relinquish all control of signals, PTZ cameras, and directional signs to Caltrans during incidents. If Caltrans is unable to assume control of these systems due to technical reasons, control shall remain with CITY. G. Additional agreements between CITY and Caltrans and possibly other cities, may be developed as needed for operating the Project equipment located in the CITY limits during major traffic incidents. 5. Maintenance A. Upon CITY's acceptance thereof, CITY shall maintain the Upgraded Equipment located within CITY's right-of-way at CITY's expense. B. CITY shall assume the associated electrical costs of the Project equipment (New and Upgraded) located within CITY's right-of-way. C. Except for communication lines, C/CAG shall maintain the New Equipment for the Term of this Agreement. Except for communication lines, CITY shall not maintain New Equipment for the Term of this Agreement. If the New Equipment becomes obsolete or no longer in use, C/CAG shall, at its own expense, remove such New Equipment from the CITY's right-of-way. D. CITY shall address graffiti removal on the Project equipment located within CITY's right-of-way pursuant to its Municipal Code. E. C/CAG agrees to obtain a maintenance contractor that specializes in ITS equipment. C/CAG and/or its maintenance contractor shall obtain an encroachment permit from the CITY for work within the CITY's right-of-way. F. C/CAG or its assignee, shall serve as lead agency to administer the maintenance service contract and/or to oversee administration of the maintenance service contract for its Project equipment maintenance responsibility.
