M/S Seybert/Gee to continue the matter for a period of two weeks and not to reopen the <br /> Public Hearing but have Vice Mayor Gee or someone else review the specific Planning <br /> issues. This to occur in order to get clarifying information on the Housing Act among <br /> other things. <br /> One Council Member questioned what will be accomplished in two weeks and <br /> expressed some doubts on what could be accomplished. This Council Member stated <br /> he was uncomfortable with this approach. <br /> Mayor Aguirre called for a vote on the substitute motion. <br /> The maker of the motion clarified that he viewed this approach as a way to buy some <br /> time to get further information and to possibly avoid litigation. <br /> Mr. Ekern, through the Mayor, asked for clarification on what will be accomplished in <br /> two weeks and if he needs to hire a third expert to analyze the cancer risks when we <br /> already have two opinions. Ms. Thompson clarified that what the City Council was <br /> suggesting was to continue to seek additional information and or if the parties agree that <br /> the parties want to discuss the issues. The maker of the substitute motion said he does <br /> not want to hire a third expert but he wants to review the data and make sure that the <br /> City avoids getting sued on this. Mr. Ekern appreciated the clarification. <br /> The maker of the original motion said that he believes the City Attorney has reviewed <br /> the matter and he trusts her judgment. The Mayor noted that if there is a finro week <br /> delay then her goal would be to get more community input. <br /> The maker of the substitute motion withdrew his motion and the Vice Mayor Gee <br /> withdrew the second. The maker of the motion said he heard his colleagues that not <br /> much can be accomplished in two weeks. <br /> The Mayor called for the vote on the original motion: <br /> Motion carried 5-1 by electronic vote with Council Member Gee opposing and <br /> Foust recused. <br /> 9.
