M/S Seybert/Gee to continue the matter for a period of two weeks and not to reopen the Public Hearing but have Vice Mayor Gee or someone else review the specific Planning issues. This to occur in order to get clarifying information on the Housing Act among other things. One Council Member questioned what will be accomplished in two weeks and expressed some doubts on what could be accomplished. This Council Member stated he was uncomfortable with this approach. Mayor Aguirre called for a vote on the substitute motion. The maker of the motion clarified that he viewed this approach as a way to buy some time to get further information and to possibly avoid litigation. Mr. Ekern, through the Mayor, asked for clarification on what will be accomplished in two weeks and if he needs to hire a third expert to analyze the cancer risks when we already have two opinions. Ms. Thompson clarified that what the City Council was suggesting was to continue to seek additional information and or if the parties agree that the parties want to discuss the issues. The maker of the substitute motion said he does not want to hire a third expert but he wants to review the data and make sure that the City avoids getting sued on this. Mr. Ekern appreciated the clarification. The maker of the original motion said that he believes the City Attorney has reviewed the matter and he trusts her judgment. The Mayor noted that if there is a finro week delay then her goal would be to get more community input. The maker of the substitute motion withdrew his motion and the Vice Mayor Gee withdrew the second. The maker of the motion said he heard his colleagues that not much can be accomplished in two weeks. The Mayor called for the vote on the original motion: Motion carried 5-1 by electronic vote with Council Member Gee opposing and Foust recused. 9. MATTERS OF COUNCIL INTEREST A.
