City and Developer desire to enter an agreement providing for the construction and <br /> installa#ion of the Improvements in accordance with the Improvement Plans. <br /> A GREEMENT <br /> NOW,THEREFORE, in consideration of the faithful performance of the terms and conditions <br /> set forth in this Agreement,tha partias hereto agree as follows: <br /> 1. Putpose. The purpose of this Agreement is to guarantee completion of the�nprovements <br /> and ensure satisfactory performance by Developer of Developer's obligations to satisfy the Conditions <br /> pertaining to the Ixnprovements, <br /> 2. Pr�ai1.,�-� 5ubject to A�reement. The Proparty sha11 be subject to this Agreement <br /> 3. Dutv to Install Improvements. Developer v✓ilI construct,install and complete,or cause to <br /> be constructed, installed and completed, at the Developar's sole cost and expense, the Improvements, in <br /> accordance with the Improvement Plans (defined in Recital E. above) and ta the satisfaction of the City <br /> Engineer, in his reasonable discretion. Developer will also supply a11 labor and materials#lierefor, a11 in <br /> strict accordance with the terms and conditions of this Agreernent.
