City and Developer desire to enter an agreement providing for the construction and <br /> installa#ion of the Improvements in accordance with the Improvement Plans. <br /> A GREEMENT <br /> NOW,THEREFORE, in consideration of the faithful performance of the terms and conditions <br /> set forth in this Agreement,tha partias hereto agree as follows: <br /> 1. Putpose. The purpose of this Agreement is to guarantee completion of the�nprovements <br /> and ensure satisfactory performance by Developer of Developer's obligations to satisfy the Conditions <br /> pertaining to the Ixnprovements, <br /> 2. Pr�ai1.,�-� 5ubject to A�reement. The Proparty sha11 be subject to this Agreement <br /> 3. Dutv to Install Improvements. Developer v✓ilI construct,install and complete,or cause to <br /> be constructed, installed and completed, at the Developar's sole cost and expense, the Improvements, in <br /> accordance with the Improvement Plans (defined in Recital E. above) and ta the satisfaction of the City <br /> Engineer, in his reasonable discretion. Developer will also supply a11 labor and materials#lierefor, a11 in <br /> strict accordance with the terms and conditions of this Agreernent. The Improvements shall include, but <br /> are not necessarily limited to,all of the following: <br /> (a) grading,paving <br /> (b) curbs,gutters,concrete wallcvvays,driveways <br /> (c} sanitary sewer system,complete <br /> (d} permeable paving <br /> {e) water system,complete <br /> (fl storm drainage system,complete <br /> (g} site lighting system,complete <br /> (h) street trees <br /> {i} landscaping and irrigation system complete <br /> (j} utility joint trenching <br /> (k} a.11 canditions of approval for Tentative Subdivision Ma.p entitled"Vesting Tentative <br /> Map,2580 El Camino Real,"heretofore issued for said subdivision, <br /> (1) and all other work, improvements, or construction required by or mentioned in the <br /> abovementioned plans and specifications,conditions of permits and all construction, ! <br /> appurtenances and improvements necessary as reasonable determined by #he City ':. <br /> Engineer to complete the aforementioned improvements,both within and ou#side of ! <br /> the abovementioned subdivision. <br /> The canstruction, ins#atlation and completion of the Improvem8nts and all labor and materials furnished <br /> in connection therewith are hereinafter referred to collectivsly as the "Work:' The Work and <br /> ATTY/AGR12012.065l2580 ECR(URBAN HOUSING)SUBDIVISION IMPROVEMEtdT AGRE£MEW7 <br /> REV;06-05-12 VR <br /> Page 2 of 16 <br />
