Laws. The laws of the State of California; the Constitution of the United States; and <br /> any codes, statutes, regulations, and executive mandates, and any court decision, state or <br /> federal, thereunder. <br /> Mitigation Project. The activities required to restore, enhance and create wetland <br /> habitat on the Mitigation Site which are or will be a condition of issuance of permits by the <br /> U.S. Army Corps of Engineers for wetland fill and construction in navigable waters, including <br /> any requirements for ongoing monitoring and management and disposition to the National <br /> Wildlife Refuge or equivalent long-term wetland manager. <br /> Mitigation Site. That pazcel of land known as Deepwater Slough Island acquired by <br /> Pacific Shores from the Port of Redwood City or such portion thereof which involves the <br /> Mitigation Project. <br /> Mortgage. A mortgage, deed of trust, sale and leaseback arrangement, assignment of <br /> leases and rents, synthetic lease, other lease financing, or other transaction in which the <br /> Property or a portion thereof, or any interest therein, is pledged as security, contracted for in <br /> good faith and for fair value. <br /> Mortgagee. The holder of a beneficial interest in the Property, under a Mortgage. <br /> Other City Facilities. All those utilities and facilities owned by City and other <br /> improvements, other than the Seaport Boulevard Improvements, located outside the <br /> boundaries of the Project Site, necessary for the full development of the Project Site which <br /> City customarily provides in connection with development in the City, including, without <br /> limitation, roads, water systems, sanitary sewers, storm drainage systems, utilities, tr�c <br /> signals, curbs, gutters, sidewalks, parks, amenities, recreational areas, landfills and bridges, <br /> without which the Seaport Boulevard Improvements cannot properly serve the site. <br /> Pacific Shores Infrastructure. All those utilities and infrastructure on the Project Site <br /> necessary for the use and development of the Project Site, including, without limitation, the <br /> Water and Sewer Facilities, Storm Drainage Joint Facilities, storm drainage lines and <br /> facilities, telephone, electrical, gas, fiber optic and cable television conduits, lines and <br /> facilities, as well as spaze conduits for unspecified uses, all of which are anticipated to be in a <br /> common trench or several common trenches, and including, without limitation all ancillary <br /> facilities necessary to system operation such as pump stations, holding tanks, retention basins, <br /> lines, ditches, and manholes, easements for use of that drainage ditch and stormwater <br /> retention channel partially owned by Pacific Shores and partially owned by Cargill Salt along <br /> the eastern and southern boundaries of the Project Site permitted to be used for stormwater <br /> retention and conveyance by permit from the U.S. Army Corps of Engineers, and including <br /> all wells and lines for irrigation and firefighting. <br /> Parcels.
