This instrument, together with any <br /> Exhibits and schedules hereto, constitutes the entire Agreement between the parties relating to <br /> the subject matter of this Agreement. This Agreement can be altered, amended or revoked <br /> only by an instniment in writing signed by the parties. No representations whatsoever have <br /> been made relating to the subject matter of this Agreement except as are expressly stated in <br /> writing in this Agreement. <br /> 38. Recordation. City shall request recordation of this Agreement in the O�cial <br /> Records of San Mateo County, California within 10 days of the Effective Date. Limitation of City's Obligations and Liability When Acting Through <br /> District. Notwithstanding any provision of this Agreement to the contrary, the performance <br /> of any duty or obligation undertaken by City through District pursuant to the terms and <br /> conditions of this Agreement is limited to and by the authority and powers conferred by City <br /> upon City acting by and through District, and any and all expenditures incurred by City in <br /> performing any such duty or obligation shall be paid out of District funds only. City's <br /> general funds shall not be liable for the performance of any such duty or obligation. <br /> 41. Port Execution.
