This instrument, together with any Exhibits and schedules hereto, constitutes the entire Agreement between the parties relating to the subject matter of this Agreement. This Agreement can be altered, amended or revoked only by an instniment in writing signed by the parties. No representations whatsoever have been made relating to the subject matter of this Agreement except as are expressly stated in writing in this Agreement. 38. Recordation. City shall request recordation of this Agreement in the O�cial Records of San Mateo County, California within 10 days of the Effective Date. Limitation of City's Obligations and Liability When Acting Through District. Notwithstanding any provision of this Agreement to the contrary, the performance of any duty or obligation undertaken by City through District pursuant to the terms and conditions of this Agreement is limited to and by the authority and powers conferred by City upon City acting by and through District, and any and all expenditures incurred by City in performing any such duty or obligation shall be paid out of District funds only. City's general funds shall not be liable for the performance of any such duty or obligation. 41. Port Execution.
