6.1.M. - Page 8
(4) San Carlos Fire Department employees are not, and shall not be
deemed, Redwood City employees for any purpose. San Carlos shall be solely responsible for all
salary, benefits, workers' compensation, and insurance for its personnel providing Cross
Firefighter Services pursuant to this Amendment. Said personnel shall be considered solely
employees of the City of San Carlos for all supervisory, disciplinary, and other employment
related purposes.
(e) Cross Services Termination Date. The Participating Agencies are currently
exploring the possibility of Redwood City providing San Carlos with expanded fire and
emergency services. The Cross Firefighter Services are intended to be provided as an interim
solution for the Participating Agencies while they continue to explore the expanded fire and
emergency services. As such, both Participating Agencies' obligations to provide Cross
Firefighter Services shall expire on January 31, 2013 ("Cross Services Termination Date"), unless
the City Manager of each Participating Agency agrees in writing to extend the Cross Services
Termination Date to a later date certain.
4. Indemnification. No Participating Agency shall be responsible for the acts or
omissions of the other Participating Agency's officers or employees, nor shall any Participating
Agency incur any liability arising out of the services of any other Participating Agency's officers
or employees. Accordingly, the Participating Agencies hereby expressly agree to waive the pro
rata risk allocation contained in Government Code section 895.6.
5. Ratification. The Participating Agencies acknowledge and agree that the
Agreement, except as amended by this Second Amendment, remains unmodified and in full force
and effect in accordance with its terms.
6. Interretation. As used in this Second Amendment, masculine, feminine or neutral
gender and the singular or plural number shall each be deemed to include the others where and
when the context so dictates. The word "including" shall be constructed as if followed by the
words "without limitation." This Second Amendment shall be interpreted as though prepared
jointly by both parties.
[Signature Page FollowsJ
ATTY/AGR/2012/AMENDMENTS/AMEND NO.2 SAN CARLOS FIRE
REV:09-06-12 VR
