6.3.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Clerk <br /> September 10, 2012 <br /> SUBJECT <br /> Conflict of Interest Code Adoption/Update — City of Redwood City, Successor Agency, <br /> including establishing the Officials for said entity, and Oversight Board Conflict of <br /> Interest Code <br /> RECOMMENDATION <br /> 1. Adopt a Resolution, with exhibits, updating the City's Conflict of Interest Code, and <br /> rescinding Resolution 15062. <br /> 2. Adopt a Resolution adopting a Conflict of Interest Code for the Successor Agency to <br /> the Redwood City Redevelopment Agency. <br /> 3. Adopt a Resolution adopting a Conflict of Interest Code for the Oversight Board for <br /> the Successor Agency to the Redwood City Redevelopment Agency. <br /> BACKGROUND <br /> California law requires designated public officials to disclose their economic interests to <br /> the public. Public officials designated by statute who disclose economic interests <br /> include City Council Members, Planning Commissioners, City Managers, City Attorneys <br /> and City Treasurers. These officials are sometimes referred to as "code filers." The <br /> purpose of the disclosure requirement is to alert both public officials and the public to <br /> any personal economic interests that may be affected during the public official's <br /> performance of duties. The disclosure occurs through the filing of the "Form 700" - <br /> Statement of Economic Interests upon taking office, on an annual basis, and upon <br /> leaving office. <br /> The City of Redwood City has in the past adopted and updated Conflict of Interest <br /> Codes for the Municipal Corporation of Redwood City and its Redevelopment Agency. <br /> With the demise of the Redevelopment Agency, and the emergence of the Successor <br /> Agency, the City has to update its Conflict of Interest Codes not just for its biennial <br /> update but to rescind the prior Redevelopment Agency Code and add the Successor <br /> Agency. In addition, per Fair Political Practices Commission guidance letter, a Conflict <br /> of Interest Code is also to be adopted for the Oversight Board. This could be done by <br /> the Oversight Board or the City. Upon consultation with legal counsel from the Oversight <br /> Board, it was timely to include this adoption with the City's revisions and additions. <br /> On August 9, 2012 the City Council, as the approving body of these Conflict of Interest <br /> Codes, received the Biennial Notice regarding changes and amendments that were <br /> needed and forthcoming. <br />
