6.3.B. - Page 1 RE PO RT To the Honorable Mayor and City Council From the Cit Mana er September 10, 2012 SUBJECT Resolution adopting new By-Laws for the Successor Agency to the Redwood City Redevelopment Agency RECOMMENDATION Adopt Resolution approving and adopting By-Laws of the Successor Agency. BACKGROUND In 1982 with the formation of the City's Redevelopment Agency, Redevelopment Agency 82-06 was adopted setting forth by-laws for such entity. Under AB 1 X 26, enacted by the California State Legislature and signed by the Governor as part of the 2011-2012 State budget, a new Part 1.85 was added to Division 24 of the California Health and Safety Code (Health and Safety Code Section 34170 et seq., as may be amended, the "Dissolution Act") and, in accordance therewith, all redevelopment agencies in the State of California, including the Redwood City Redevelopment Agency ("Redevelopment Agency"), were dissolved as of February 1, 2012. In compliance with the Dissolution Act, the City of Redwood City ("City") determined it would serve as the Successor Agency to the Redwood City Redevelopment Agency ("Successor Agency") effective February 1, 2012; and AB 1484, enacted by the California State Legislature and signed by the Governor as part of the 2012-2013 State budget, amended the Dissolution Act, and declared that the Successor Agency is a separate legal entity from the City. ANALYSIS With the creation of the Successor Agency as a separate legal entity, it is necessary to establish officials and by-laws for such body. This action sets forth the positions related to the Successor Agency. ALTERNATIVES Council could opt to lack clarity on Officials serving under the Successor Agency and omit the establishment of by-laws.
