6.3.B. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> September 10, 2012 <br /> SUBJECT <br /> Resolution adopting new By-Laws for the Successor Agency to the Redwood City <br /> Redevelopment Agency <br /> RECOMMENDATION <br /> Adopt Resolution approving and adopting By-Laws of the Successor Agency. <br /> BACKGROUND <br /> In 1982 with the formation of the City's Redevelopment Agency, Redevelopment <br /> Agency 82-06 was adopted setting forth by-laws for such entity. Under AB 1 X 26, <br /> enacted by the California State Legislature and signed by the Governor as part of the <br /> 2011-2012 State budget, a new Part 1.85 was added to Division 24 of the California <br /> Health and Safety Code (Health and Safety Code Section 34170 et seq., as may be <br /> amended, the "Dissolution Act") and, in accordance therewith, all redevelopment <br /> agencies in the State of California, including the Redwood City Redevelopment Agency <br /> ("Redevelopment Agency"), were dissolved as of February 1, 2012. <br /> In compliance with the Dissolution Act, the City of Redwood City ("City") determined it <br /> would serve as the Successor Agency to the Redwood City Redevelopment Agency <br /> ("Successor Agency") effective February 1, 2012; and <br /> AB 1484, enacted by the California State Legislature and signed by the Governor as <br /> part of the 2012-2013 State budget, amended the Dissolution Act, and declared that the <br /> Successor Agency is a separate legal entity from the City. <br /> ANALYSIS <br /> With the creation of the Successor Agency as a separate legal entity, it is necessary to <br /> establish officials and by-laws for such body. This action sets forth the positions related <br /> to the Successor Agency. <br /> ALTERNATIVES <br /> Council could opt to lack clarity on Officials serving under the Successor Agency and <br /> omit the establishment of by-laws. <br />
