6.5.D. - Page 3 <br /> In the case of Block 2 (because the bonds have been paid off), such amendment would <br /> allow the City to use the sales proceeds from the proposed Bock 2 sale for purchase or <br /> improvement of other off-street parking, to pay off parking loans, or for any other <br /> municipal purpose. <br /> In addition to the substantive amendments provided above, the Ordinance's language <br /> relating to the Ordinance's superiority over the Parking District Law of 1951 could use <br /> some clarification to make clear when the City Ordinance or the Parking District Law of <br /> 1951 controls. It was the intent of Ordinance 785 when adopted that it supersede and <br /> control over the provisions of the Parking District Law of 1951. The amendment <br /> proposed would make clear the Ordinance supersedes the Parking District Law of 1951 <br /> both where the provisions of the Parking District Law of 1951 are inconsistent and also <br /> where the subject matter is inconsistent with the City's Ordinance. <br /> As such, it is recommended that Ordinance No. 785 be amended as provided in <br /> Attachment 1 to this staff report, to (a) provide the City with more flexibility to use the <br /> proceeds of City's sale of property, and (b) clarify the meaning of the Ordinance to <br /> specifically state that the Ordinance supersedes and controls over the Parking District <br /> Law of 1951. <br /> ALTERNATIVES <br /> 1. Do not adopt the proposed ordinance amendment and retain the requirements <br /> and language of Ordinance No. 785 as originally adopted. <br /> 2.
