8.A. - Page 5 <br /> agreement to continue to negotiate in good faith. The City would have no role in sale of <br /> this property and, of course, could not require it as a condition of approval. <br /> Consequently, staff recommends the City Council approve the subdivision as proposed <br /> with nine lots, and modify the proposed Planned Development in accordance with the <br /> Owner/Developer and neighborhood's proposal to move the houses on lots 3 and 4 at <br /> least 25 feet from the top of bank, and to increase the setback of lot 7 to 20 feet. <br /> ALTERNATIVES <br /> 1. Do not certify the Environmental Impact Report and deny the proposed project. <br /> 2. Certify the Environmental Impact Report and approve the alternative <br /> recommended by the Planning Commission regarding a 25' building setback <br /> from the top of creek bank. <br /> 3. Certify the Environmental Impact Report and approve the project as proposed by <br /> the developer. <br /> 4. Certify the Environmental Impact Report and adopt any of the Alternatives <br /> identified in the EIR as the approved project (this includes options proposed by <br /> the neighborhood relating to single ingress/egress point). <br /> 5. Certify the Environmental Impact Report and adopt the modifications proposed <br /> by the developer (i.e., some setbacks from the creek, reductions to houses on <br /> Lots 7 & 8). <br /> 6.
