8.A. - Page 7 ATTACHMENT 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY CERTIFYINGTHE FINAL ENVIRONMENTAL IMPACT REPORT <br /> FOR THE FINGER AVENUE NINE-LOT PLANNED DEVELOPMENT <br /> PROJECT; ADOPTING CEQA FINDINGS, AND ADOPTING A <br /> MITIGATION MONITORING AND REPORTING PLAN, ALL IN <br /> ACCORDANCE WITH THE REQUIREMENTS OF THE CALIFORNIA <br /> ENVIRONMENTAL QUALITY ACT <br /> WHEREAS, Kirk McGowan dba McGowan Development ("Applicant") submitted <br /> applications to the City of Redwood City ("City") for (i) a Planned Development Permit, <br /> including Modifications to zoning district regulations, and (ii) a Vesting Tentative Map, <br /> including Exceptions to the Subdivision Ordinance (the "Finger Avenue Project" or <br /> "Project"); and <br /> WHEREAS, on October 26, 2009, Redwood City adopted a mitigated negative <br /> declaration ("MND") pursuant to the requirements of the California Environmental <br /> Quality Act (Public Resources Code section 21000 et seq.; hereafter, "CEQA"), and its <br /> implementing regulations (Title 14, sections 15000 et seq. of the California Code of <br /> Regulations; hereafter, the "CEQA Guidelines") and approved the Finger Avenue <br /> Project; and <br /> WHEREAS on November 10, 2009, Friends of Cordilleras Creek and Finger <br /> Avenue Pride Committee (collectively "Friends") filed a lawsuit with the San Mateo <br /> County Superior Court seeking to set aside the City's adoption of the MND and <br /> approvals of the Finger Avenue Project, alleging in the lawsuit violations of CEQA; and <br /> WHEREAS, on July 26, 2010, the City of Redwood City, McGowan Development <br /> and Friends (the "parties") entered into a Settlement Agreement, whereby the parties <br /> agreed that the City would rescind all of the approvals (MND, Planned Development <br /> Permit, and Vesting Tentative Map) related to the Finger Avenue Project; and <br /> WHEREAS, the Parties also agreed to prepare an environmental impact report <br /> ("EIR") to analyze the related environmental impacts associated with the Finger Avenue <br /> Project; and <br /> WHEREAS, the parties further agreed that the 2008 Initial Study associated with <br /> the MND sufficiently evaluated the Project's remaining potential impacts and so the EIR <br /> need not evaluate potential impacts other than those listed above; and <br /> ATTY/RES0.2783/CC FINGER RESO CERTIFYING FINAL EIR <br /> REV:08-31-12 VR <br /> Page 1 of 42 <br />
