WHEREAS, this City and the Fair Oaks Sewer Maintenance District <br /> desire to provide for sanitary sewerage treatment capacity rights, <br /> both grant eligible and non-grant eligible (as defined in the <br /> agreement hereinafter referenced) in a maximum amount for the benefit <br /> of said District, subject to certain terms and conditions, and to <br /> provide for partial and ultimately complete supersession of the <br /> aforementioned agreement dated July 15, 1947, as amended, and other <br /> matters; <br /> NOW, THEREFORE; <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> AS FOLLOWS: <br /> 1. That certain agreement entitled "Agreement - Sanitary <br /> Sewerage Treatment Capacity Rights and Services" (form dated 10/25/78) , <br /> by and between the City of Redwood City, a municipal corporation of <br /> the State of California, and the Fair Oaks Sewer Maintenance District, <br /> a sewer maintenance district of the County of San Mateo, State of <br /> California, providing for grant eligible and non-grant eligible <br /> sanitary sewerage treatment capacity rights in specified maximum <br /> amounts for the use of said District, subject to certain terms, <br /> conditions, and provisions set forth in said agreement, a copy of <br /> which agreement is on filed in the office of the City Clerk, to <br /> which copy reference is hereby made for the full particulars thereof, <br /> is hereby approved, and the City Manager is hereby authorized and <br /> directed to execute said agreement for and on behalf of the City of <br /> Redwood City. <br /> 2. The City Clerk is hereby authorized and directed to transmit <br /> a certified copy of this resolution, together with a duplicate original <br /> of the agreement approved hereby, to the Board of Supervisors, <br /> County of San Mateo, California. <br /> -2- <br />
