09/10/2012 <br /> WHEREAS, the parties further agreed that the 2008 Initial Study associated with the <br /> MND sufficiently evaluated the Project's remaining potential impacts and so the EIR need not <br /> evaluate potential impacts other than those listed above; and <br /> WHEREAS, the Settlement Agreement also stipulated the minimum range of project <br /> alternatives to be considered in the environmental review for the Project, designed to be <br /> potentially feasible and to meet most project objectives; and <br /> WHEREAS, from January 25, 2011 through February 23, 2011 the City held a public <br /> review period on the Notice of Preparation (NOP) for the Finger Avenue Project EIR. The City <br /> mailed, published and posted on its website a NOP to notify responsible agencies of the State <br /> Office of Planning and Research, all parties to the Settlement Agreement and surrounding <br /> property owners that an EIR would be prepared for the Project in accordance with the stipulated <br /> judgment of the Superior Court for the County of San Mateo; and <br /> WHEREAS, on July 22, 2011, City staff issued a Notice of Availability to announce the <br /> availability of the Draft Focused Environmental Impact Report for the Finger Avenue Nine-Lot <br /> Planned Development Project ("Draft EIR") for public and responsible agency review and input; <br /> and <br /> WHEREAS, the Draft EIR was circulated for public review and comment for 45 <br /> days beginning on July 22, 2011 and ending on September 6, 2011, and was filed with <br /> the State Office of Planning & Research under State Clearinghouse No. 2008112100; <br /> and <br /> WHEREAS, on August 16, 2011, the Planning Commission held a duly noticed public <br /> hearing and received public testimony on the Draft EIR. The City received a number of letters <br /> and emails from the public during the Draft EIR public review period; and <br /> WHEREAS, on August 29, 2011, at a regularly scheduled Historic Resources Advisory <br /> Committee (HRAC) meeting, the HRAC provided input on the Cultural Resources Section of the <br /> Draft EIR, and adopted a motion finding that the Cultural Resources Chapter of the Draft EIR <br /> was complete and adequate for purposes of CEQA. The Final EIR addresses the HRAC input <br /> on the Draft EIR; and <br /> WHEREAS, pursuant to the requirements of CEQA and the CEQA Guidelines, <br /> the City has caused the preparation of written responses to the comments received <br /> ATTY/RES0.2783/CC FINGER RESO CERTIFYING FINAL EIR RESOI.#15217 <br /> REV:08-31-12 VR MUFF#613 <br />
