09/10/2012 WHEREAS, on September 10, 2012, the City Council held the continued public hearing and certified the Final EIR prepared by the City in accordance with the requirements of CEQA and, based on the EIR, adopted a Mitigation Monitoring and Reporting Program in compliance with all CEQA requirements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: 1. The above recitals are true and correct and together with the Staff Report and the application materials, including without limitation the Final EIR, vesting tentative map, and all other documents, reports, studies, memoranda, maps, oral and written testimony, and materials in the City's file for the applications and the Project, and all adopted City planning documents relating to the Project and the property including the City's General Plan, Zoning Ordinance, and other applicable City laws and regulations, and all associated approved and certified environmental documents, have together served as an adequate and appropriate evidentiary basis for the findings and actions set forth in this Resolution. 2. The City of Redwood City is the lead agency under CEQA for preparing the Final EIR, and the City Council is the final decision-making authority with regard to approval of the Finger Avenue Project as defined in section 15356 of the CEQA Guidelines. 3. The City Council finds that the Final EIR for the Project was presented to the City Council, that the Final EIR was prepared, published, circulated, reviewed and comp�eted in full compliance with State law and CEQA Guidelines, that there was adequate public review of the Draft EIR, that it has considered all comments on the Draft EIR and responses to comments, that the Final EIR adequately discusses all significant environmental issues, and that the Final EIR reflects the independent judgment and analysis of the City Council. 4. The City Council has reviewed and considered the information contained in the Final EIR prior to taking action on the proposed Finger Avenue Project. 5. The information added in the Final EIR does not constitute significant new information requiring recirculation of the Draft EIR, but rather that additional information clarifies or amplifies an already adequate EIR. 6. Pursuant to CEQA section 21081 and CEQA Guidelines section 15091, and in support of its approval of the Project, the City Council has reviewed and considered the CEQA Findings of Fact for the Project, attached hereto as Exhibit A and incorporated herein by reference, and hereby adopts the attached CEQA Findings of Fact. 7. Pursuant to California Public Resources Code section 21081 and the CEQA Guidelines section 15091(a)(1), the City Council hereby finds that changes or alterations have been required in, or incorporated into, the Project which avoid or substantially lessen the ATTY/RES0.2783/CC FINGER RESO CERTIFYING FINAL EIR RESOI.#15217 REV:08-31-12 VR MUFF#613
