6.1.E. - Page 62 <br /> {d} Pro�iding that Contractor's insurance co�erage will be primary <br /> insurance with respect to City, its Council, officers, boards, <br /> commissions, employees, and agents, and any insurance or s�lf- <br /> insurance maintained by City for itself, its Co�ncil, officers, boards, <br /> commissions, employees, ar agents shall be in excess of <br /> Contractnr's insurance and not contributory with it. <br /> 16. NON-DISCRIMINATION AND EQUAL OPPORTUNITY. Contractar <br /> hereby warrants and agrees that, in fhe performance af this Agreement, it wifl not, <br /> in connection with the employment, advancement or discharge of emplayees, or <br /> in cannection with the terms, conditior�s or privileges of their empbyment, <br /> discriminate against person because of their age, except upon #he basis of �ona <br /> fide occupational qualification, retirement plan or statutory requirement, and will <br /> not specify, in soficitations or advertisement for empfoyees to work on this <br /> Agreement, a maximum age limit, unless such limit is based upon a bana fide <br /> occupational qualificatian, retirement plan ar sta#utary requiremen#. <br /> Contractor further warrants and agrees tF�at it will comply with alf <br /> provisions of Executive Order 11246 of September 24, 1965, as amended, and of <br /> the rules, regulations and relevant orders of the Secretary of Labor; and that it <br /> wifl not discriminate against ar�y emp�oyee or applicant fnr employment because <br /> of race, colar, refigion, sex or natianal origin. Contractor will take afFirmative <br /> actian to ensure that applicants are employed, and that emplayees are treated <br /> during employment, without regard tn their race, color, religian, sex or national <br /> origin.
