Nothing contained in this Agreement wifl <br /> create any contractual re�atio�ship between any subcontractor of Contractor and <br /> City. HOLD HARMLESS. Contrac#or �ereby agr�es to defend, indemnify <br /> and save harmfess City, its Council, officers, boards, corrEmissions, agen#s and <br /> employ�es (collectively, "Indemnitees") against and fram any and al! claims, suits <br /> or actions of every name, kind and description, which may be brought against <br /> Indemnitees, or any of them, by r�ason of any injury to, ar d�ath af, any person <br /> (induding carparations, partnerships and association) nr damage suffered or <br /> sustained by any such person or property damage (including loss of use thereof� <br /> arising from, or afleged to have arisen fram, any act ar omission to act, negligent <br /> ar otherwise, of Contractor, its officers, agents or employees under this <br /> Agreement. <br /> The duty of Con#ractor #o d�fend, indemnify and save harmless, as set <br /> forth herein, wilf include t#�e duty to defend as set forth in Sectian 2778 af the <br /> California Ci�ii Code; provided, however, that not�ing herein will be construed to <br /> require Contractor to indemnify Indemnitees against any responsibility or liability <br /> in contra�entior� of Section 2782 af the Cafifornia Civfl Code.
