<br /> (d) Providing thaf Contractor's insurance coverage will be primary
<br /> insurance with respect to City, its Cauncil, officers, bflards,
<br /> commissions, employees, and agents, and any insurance or self�
<br /> insurance maintained by City for itself, its Council, officers, boards,
<br /> commissions, empfoyees, or agents shall be in excess of
<br /> Contractor's insurance and not cantributory with it,
<br /> 16. NON-DISCRIMINATION AND EQUAL OPP�RTUNITY. Contractor
<br /> hereby warrants and agrees that, in the performance of this Agreement, it will not,
<br /> in connection with the employme�t, advar�cement or discharge of emplayees, or
<br /> Fn connection with the terms, conditians or privileges of their em�loyment,
<br /> discriminate against person b�cause of their age, except upon the basis af bona
<br /> fid� occupational qualificatinn, retirement plan or statutnry requir�ment, and will
<br /> not specify, in solicitations ar advertisement for emplayees to work on this
<br /> Agreement, a maximum age limit, unless such limit is based upon a bona fide
<br /> occupational qualificatian, retirement plan or statutory requirement.
<br /> Contractor further warrants and agrees that it will comply with all
<br /> provisions of Executive Order 11245 of September 24, 1965, as amended, and of
<br /> the rules, regulatians and relevant orders of the Secretary of Labor; and that it
<br /> will not discriminate agajnst any employee or applicant for em�lnyment because
<br /> of race, colar, religion, sex or natior�al origin. Contractor will take affirmative
<br /> actiorr to ensure that applicants are employed, and that employees are treat�d
<br /> d�ri�g empinyment, without regard to their race, color, religion, sex or national
<br /> origin. Such action will include, but not be �imited to, the fallawing: employment,
<br /> u�grading, demotion, or transfer, recruitment ar recruitment advertising; layoff or
<br /> termir�ation; rates af pay or other forms of compensation; and selectian for
<br /> training, including apprenticeship.
