HOLD HARMLESS. Contractor hereby agrees to defend, ind�mnify <br /> and save harmless City, its Council, officers, boards, camrrEissians, agents and <br /> empfoyees (collec#i�ely, "Indernnitees") against and from any and alf claims, suits <br /> or actions af every name, kind and description, whicl� may be brough# against <br /> Indemnit��s, or any of them, by reason of any injury to, or deafh of, any person <br /> (including carporations, partnerships and association) or damage suffered or <br /> sustai�ed by ar�y such person or property damage (including loss of use thereof� <br /> arising from, ar alleged to have arisen from, any act or arr�issian to act, negligent <br /> or otherwise, of Contractar, its officers, agents or employees under this <br /> Agreement. <br /> The duty of Contractor to defend, indemnify and save harmless, as set <br /> forth herein, will include the duty to defe�d as set fort� in Section 2778 of the <br /> Cali#ornia Civil Cade; provided, however, that nothing nerein will be construed to <br /> require Contractor ta indemnify Indemnitees against any responsibility or liabilify <br /> in contravention of Section 2782 of the California Civil Code.
