6.5.B. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> September 24, 2012 <br /> SUBJECT <br /> An Ordinance Amending Chapter 1 and Chapter 32 of the Redwood City Code Relating <br /> to Claims against the City <br /> RECOMMENDATION <br /> Waive Second Reading and Adopt an Ordinance Amending Chapter 1 and Chapter 32 <br /> of the Redwood City Code Relating to Claims against the City. <br /> BACKGROUND <br /> The proposed ordinance came before the City Council for first reading and introduction <br /> at the September 10, 2012 City Council meeting. It is before the City Council at this <br /> meeting for adoption. <br /> The provisions in the Municipal Code specifying how claims against the City must be <br /> filed, including claims for refunds, and of taxes paid, are in need of updating. <br /> ANALYSIS <br /> These revisions are procedural in nature and therefore do not require additional <br /> authorization from the voters. The proposed ordinance specifies the requirements for <br /> filing a claim against the City which is a perquisite to filing suit against the City. The <br /> ordinance also specifies the requirements for filing claims for refunds of taxes. <br /> Requiring each claimant to file a claim is an area in litigation currently. Pending the <br /> resolution of the issue, this ordinance will provide the maximum protection to the City. <br /> ALTERNATIVES <br /> 1. Do not adopt the proposed ordinance. <br /> 2. Direct staff to make changes to the proposed ordinance. <br /> FISCAL IMPACT <br /> The proposed ordinance will provide better protection to the City and thus may result in <br /> savings to the City. <br /> ENVIRONMENTAL REVIEW <br /> This ordinance is not a "project" within the meaning of the California Environmental <br /> Quality Act.
