<br /> negotiate and participafe in any discussion with governmental agencies and
<br /> enviranme�rtal consultants regarding any settlem�nt agreement, cleanup or
<br /> abatement agreement, consent decree ar ot�er compromise �rroceeding
<br /> in�al�ing Hazardous Material, and any ather abatern�nt or clean-up plan,
<br /> strategy and procedure. For purposes her�of, "Hazardous Ma�erial" means
<br /> material that, beca�se of its quanfity, cor�centration or physical ar chemicai
<br /> characteristics, is at any time now or hereafter deemec! by at�y fiederal, state or
<br /> local governmental authorfty to pose a present or potential hazard to public
<br /> health, welfare or the ertvironr�er�t, Hazardous Material includes, withouf
<br /> limitation, the following: any materiai or substanee defiined as a "hazarclous
<br /> substance, polfutant or contaminant" pursuant to the Cornprehensive
<br /> Enviro�tmenta� Response, Compensation ar�d Liability Act of 1980, as amendecf,
<br /> 42 U.S.C. Sections 9601 et seg., ar pursuant to Section ,25316 of the Caf�fornia
<br /> Healfh & Safety Code ar any other federal, state, or local Law; a "hazarclous
<br /> waste" listed pursuant #a Section 25140 of the California Health & Safety Code;
<br /> any asbes#os and asbestos containing r�aterials whether ar nat such maferials
<br /> are par# of the License Area ar are naturaify occurring substances in the License
<br /> Area; and any petroleum, including, witho�t limitation, crude oil or any fraction
<br /> thereof, nafurai gas or natural gas [iquids, provided, the foregoing shall not
<br /> prohibit COUNTY from traversing to, from and across fhe License Area in
<br /> standard motor �ehicles. Tf�e term "release" ar "#f�reatened release" when used
<br /> with respect to Hazardous Materiaf shali include any actual or imminent spiNing,
<br /> leaking, pum�ing, pouring, emitting, emptying, dischargEng, injecfiir�g, escaping,
<br /> IeachEng, dumping, or disposing in, on, under or abo€�t the License Area.
<br /> E. Nuisances. COUNTY sha�f not conduct any acti�ities in, on, under or about
<br /> the License Area that constitute waste, nuisance or unreasonabfe annoyanc�
<br /> (including, without limitation, emission of objectionabfe odars, nnises or �ights) #o
<br /> CITY, to the own�rs ar occupants of neighboring property, or to the �ublic, or that
<br /> canstitute waste or nuisance per se.
<br /> F. Use of Acljoining ,l�and. COUNTY acknowleclges fhat the pri�ilege given
<br /> under this Agreement shall be limited strictly to the License Area. COUNTY shall
<br /> naf traverse ouer or otherwise use any ac�joining lands of CITY.
<br /> G. Pondin�; Water Courses. COUNTY shall not cause any ponding on the
<br /> License Area or any ffaading an acl�acent land. COUNTY shall not engage in any
<br /> activity tha� causes any cha�ge, disturbance, fill, aiteration or impairment to the
<br /> bed, bank ar channe! af any natural wafer course, wetland, or other body o�Fwater
<br /> on, in, ur�der a� a�out the License Area, r�or shalf COUNTY engage in any
<br /> activity t�af co[�Id pollute or degrade any surfac� or subsurface waters or result in
<br /> the dirrtinufion ar drainage af such wat�rs.
