6.2.B. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> October 8, 2012 <br /> SUBJECT <br /> Amend Resolution No. 15143 to Make Minor Change for Purpose of Legal Compliance <br /> and Affirm Prior Appointments <br /> RECOMMENDATION <br /> Amend Resolution No. 15143 to make minor change for purposes of legal compliance <br /> and affirm prior appointments. <br /> BACKGROUND <br /> Based on a recommendation from the City Manager's Department, on September 12, <br /> 2011, the City Council made a number of changes to the Architectural Advisory <br /> Committee by resolution. All of the changes were adopted except one relating to the <br /> size of the committee. The City Council decided to maintain the committee membership <br /> at five instead of the recommended three. The resolution refers to a quorum as two, <br /> which is proper for a three-person committee, but not for a five-person committee where <br /> the quorum is three. Accordingly, the applicable resolution needs to be amended to <br /> comply with law. <br /> In addition, Resolution 15143 requires that all five members of the committee be <br /> licensed architects or landscape architects. The recruitment taking place immediately <br /> after its adoption did not note this change in qualifications. In fairness to those who <br /> participated in that recruitment and were selected for membership, it is recommended <br /> that members who are already appointed be grandfathered in until their terms expire. <br /> This affects one member. <br /> ANALYSIS <br /> The necessary amendment to comport with law is reflected in amended Resolution No. <br /> 15143. Any applicant appointed in 2011 under the prior rules will be grandfathered in <br /> until his/her term expires. <br /> ALTERNATIVES <br /> None. <br /> FISCAL IMPACT <br /> There is no fiscal impact. <br />
