Conduct a Public Hearing 2. Waive Second Reading and Adopt an Ordinance to Amend Sections 5.1 and 5.80 of Chapter 5 of the Redwood City Code Pertaining to Regulations for Animal Control; County Regulations Adopted. BACKGROUND At the September 10, 2012 City Council Meeting, an ordinance to amend Sections 5.1 and 5.80 of Chapter 5 of the Redwood City Code pertaining to regulations for animal control was introduced, and an October 8, 2012, public hearing was set. The proposed ordinance adopts San Mateo County's animal control regulations by reference and adopts the same fees as adopted by the county. State law requires that a public hearing be held when codes are adopted by reference. ANALYSIS Licensing and other animal control fees are set and collected by the County, as a means of cost recovery for this mandated program. The cities contracting with the County for animal control services, including Redwood City, must maintain the same animal control and licensing program fee structure as the County. To accomplish this, Redwood City's Municipal Code Sections 5.1 and 5.80 must be amended to reflect the changes in the County's ordinance. As required by state law, notice of this public hearing has been appropriately published, and the proposed ordinance and a certified copy of the County ordinance being adopted by reference are available in the City Clerk's office for public review. ALTERNATIVES Section B.1 of the City's agreement with San Mateo County for animal control services requires the City to maintain the same animal control licensing and fee structure as the County; therefore there is no alternative to the recommended action.
