8.A. - Page 10 <br /> II. PROPERTY ACQUISITION <br /> A. GUIDING PRINCIPLES <br /> The City should consider acquiring properties if: <br /> • There is a demonstrated immediate public need <br /> • There is a master plan for the expansion of specific City services and facilities <br /> • The future land use is compatible with the General Plan, the City's Precise Plans <br /> and the City Council's Strategic Initiatives. <br /> B. PURCHASE <br /> The following guidelines apply to the purchase or rental of real property interests, whether in <br /> the form of fee title, leasehold interests, rights-of-way or easements; and whether leased or <br /> purchased with City funds or acquired via grants, donations, gifts, dedications via the <br /> development review process or property exchanges. <br /> 1. Acquisition with City Funds. <br /> The City Council should engage first in determining strategic objectives <br /> relating to property acquisition such as increasing park space or <br /> affordable housing stock. However, in some cases, opportunities may <br /> present themselves and the City Manager may initiate work associated <br /> with a potential acquisition consistent with the City Manager's <br /> purchasing authority and consistent with the general guidelines below <br /> including seeking City Council authorization to negotiate the acquisition <br /> of any real property. <br /> Acquisition proposals should be consistent with adopted plans and <br /> policies, including the adopted CIP. To the extent foreseeable, property <br /> purchase recommendations should be included with the Budget/CIP <br /> process. In any case, the City Council must authorize negotiations and <br /> approve the acquisition of any real property. <br /> Depending on the complexity of the transaction, market conditions and <br /> other circumstances at the time, the City may choose to be represented <br /> by a broker or other third party professionals in acquiring real property. <br /> ATTY/POLICIES/PROPERTY ACQUISITION AND DISPOSITION PROCEDURES <br /> REV:10-04-12 PT <br /> Page 5 of 21 <br />
