The Origl�al Agreement was previo�sfy amended hy Amendment No. �, dated <br /> July 12, 20a5, Amendment No. 2 on June 30, 2008, Amendment No. 3 on <br /> 5eptember 14, 2009, Amendrnenk Na. 4 on August 23, 2010, Amendrnent No. 5 <br /> on September 2D, 20�1, and agaln by this Amendment, The Original Permit and <br /> a!! previous amendments ar� colfectively referred to herein �s the "Origir�a! <br /> Permit as Amended"; and <br /> C, Permfttee continues to meet the terms and conditions of the Origina! Permit as <br /> Amended; and ' <br /> D, The F'ermit aliows �n annual increase in the Mon�hly Fee by up ta five percent <br /> (5%), and t�e Mon#h!y �ee was last increased in 2Q11 �y 5% thrnugl� <br /> Amendment No. 5; and <br /> E. The City deslres #o ir�crease the MonthEy Fee by five peraent (5%). <br /> NOW, THER��ORE, in cor�sideration nf the recftals and the mutuaf covena�ts <br /> contained herein, tf�e ParEies agree as follows: <br /> �. Cnmmencing Qctober �, 2012, Section 8 af the Origlnal Wermit as <br /> Arnended, entitled "Monthly Fee"will �e amended to lncrease the Mon�l�ly Fee by five <br /> percent {5%) or Two Hundred and Twenty-Thrae Dollars and 7hirty-F'ive Cents <br /> {�223.35). The new Monthfy �ee will be Four Thousand Six Hundred Ninety and <br /> Thirty-Three Cents ($4,690.33). <br /> 2.
